Present and Discuss the Final Conceptual Design for the Beltway Drive Trail and Greenspace and Review Recommended Trail and Wayfinding Signage.

On December 14, 2021, Council approved a professional services agreement with Moore Iacofano Goltsman, Inc. (MIG) for the conceptual design of the Beltway Drive Trail Project. The Beltway Drive Trail Project was identified as a Phase 1 project in the City-Wide Trails Master Plan (CWTMP) that was adopted by Council on May 25, 2021. In addition to the proposed trail and greenspace improvements for Beltway Drive, the CWTMP also recommends the development of Trail Signage and Wayfinding Standards. Development of these standards is included in the scope of the Beltway Drive Trail Project to be included in all future trail signage projects. 

On August 23, 2022, a staff presentation to Council included results of public input and staff's recommendations for moving forward with the conceptual design. The final conceptual design of Beltway Drive Trail and Greenspace is complete and staff will make a presentation to the Council for review. Also included in the presentation is the development of Trail Signage and Wayfinding Standards, which are the last steps prior to the development of construction documents. In addition to this presentation, staff placed an item on the consent agenda to approve an agreement with MIG for the development of construction documents for the Beltway Drive Trail Project.

Addison Oktoberfest is a major festival produced by the Town annually to support local businesses and promote tourism. The festival features food, music and entertainment focused on German culture, and was held September 15-18, 2022 at Addison Circle Park. The Special Events and Finance Departments have prepared a report on the marketing, operational and financial outcomes of Addison Oktoberfest 2022.

Present and Discuss the Airport Quarterly Report for the Fiscal Year 2023 First Quarter Ended December 31, 2022.

• Galaxy FBO formally began operations on November 1, 2022. They are off to a very good start, moving more than 120,000 gallons of fuel in each of their first two months (November and December).
• Galaxy FBO hosted the FIFA World Cup Trophy Tour aircraft and event on November 6, 2022. Addison was one of only three U.S. stops on the World Cup Trophy Tour; the other two stops were Los Angeles and New York / New Jersey (Newark Liberty International Airport).
• Million Air sold more than 6,000,000 gallons of Jet-A in calendar year 2022, passing the milestone on the afternoon of December 27, 2022 and setting an all-time record for them (or any other FBO at Addison, for that matter).
• Airport revenues in the first quarter of Fiscal Year 2023 (FY23) were the highest ever ($1,722,757) for the first quarter of any fiscal year, up 11.5% compared to the first quarter of FY22 and 26.8% compared to the first quarter of FY21. The increase is attributable to the strong performance of the airport's real estate portfolio, which has generated additional revenue from new ground leases such as the Galaxy FBO lease.
• Operations and fuel flowage, while generally lower than the first quarter of FY22 (which set records), were strong for the first quarter of FY23.

Consider action on a Resolution Approving an Agreement with Moore Iacofano Goltsman, Inc. (MIG) for Professional Engineering Services for the Development of Construction Documents for the Addison Beltway Drive Trail Project and Authorizing the City Manager to Execute the Agreement  in an Amount Not to Exceed $223,000.

The City-Wide Trail Master Plan (CWTMP) was adopted by Council on May 25, 2021. Pages 40-41 of the plan identify Phase 1 projects that are recommended to be completed within 0-5 years of the date of adoption. The development of a trail system along Beltway Drive between Marsh Lane and Belt Line Road is included in the CWTMP's Phase 1 recommendations. Specific recommendations for the Beltway Drive Trail project, based on community input, include:

• Buffered Bike Lanes between Marsh Lane and Midway Road.
• Bicycle Boulevard between Midway Road and Belt Line Road.
• Wide Sidewalk with Buffer from the Redding Trail heading east to Belt Line Road.

On December 14, 2021, Council approved a professional services agreement with Moore Iacofano Goltsman, Inc. (MIG) for professional engineering services for conceptual design of the Beltway Drive Trail project for an amount not to exceed $65,998. The development of Trail Signage and Wayfinding Standards and the development of a Public Input Survey were included in the Beltway Drive Trail scope of services. The Public Input Survey created by MIG was conducted by staff to gather information to help guide the development of the conceptual design. On August 23, 2022, a staff presentation to Council included results of public input and staff's recommendations for moving forward with the conceptual design.

Council approved $223,000 in the Fiscal Year 2023 Budget for the development of construction documents for Addison Beltway Drive Trail and Greenspace as a result of the approved conceptual  plan. Town staff selected Moore Iacofano Goltsman (MIG), the firm that developed the Beltway Drive Trail and Greenspace conceptual plan, as the most qualified team to complete the construction documents for the project. MIG is listed in the Town's pre-qualified consultant pool which was established through the selection process for Bid Number 17-180 Request for Qualifications for various Town projects. MIG's proposal includes preparation of topographic surveying, estimate of probable construction costs, development of construction documentation, bidding support and construction oversight.

Consider Action on a Resolution Approving a First Amendment to Ground Lease with AQRD Hangar Management, LLC for 4582 and 4584 Claire Chennault Drive at Addison Airport and Authorizing the City Manager to Execute the First Amendment to Ground Lease.

AQRD Hangar Management’s ground lease commenced October 1, 2022 (“Ground Lease”). The permitted use of the leased premises is for the sale of aircraft and aircraft parts, aircraft maintenance and repair, aircraft storage, aircraft training, aircraft charter, and aircraft rentals.

The Ground Lease consists of two former airport lease parcels. As described in the Ground Lease, landlord and tenant desire to merge the two parcels into one consolidated parcel described by the new property survey. White Hawk Engineering completed their resurvey of the premises on December 18, 2022. The proposed First Amendment to Ground Lease adopts the new survey by amending and superseding Exhibit “2” - Legal Description of Demised Premises and Exhibit “3” - Legal Description of the Demised Premises of the Ground Lease. Furthermore, Section 3.A.3 of the Ground Lease requires the Base Rent to be recalculated based upon the new property survey as follows:

Consider Action on a Resolution Approving the First Amendment to Conventional Hangar Lease for Commercial Aviation Use with Jani-King International, Inc. for 4572 Claire Chennault Drive at Addison Airport and the Termination of the 4570 Claire Chennault Drive Conventional Hangar Lease for Commercial Aviation Use with Jani-King International, Inc. and Authorizing the City Manager to Execute the Agreements. 

Jani-King International, Inc. (“Jani-King”) is a longtime tenant and the operator of Cavanaugh Flight Museum (“Cavanaugh”), a 501c3 non-profit educational flight museum, at Addison Airport. Jani-King’s ground leases for 4570 and 4572 Claire Chennault Dr. expired in 2021. The Town of Addison and Jani-King entered into two separate commercial lease agreements to allow Cavanaugh to continue its use and occupancy of these facilities. Jani-King’s ground lease for 4574 Claire Chennault Dr. expired November 30, 2022, but was allowed to continue on a month-to-month basis in anticipation of the outcome of this proposal. Jani-King also subleases another ground leased property located at 4576 Claire Chennault Dr., which lease is due to expire in September 2023, at which time ownership of those building improvements will revert to the Town of Addison.

The proposed First Amendment to Conventional Hangar Lease for Commercial Aviation Use (“First Amendment”) for 4572 Claire Chennault Dr. is intended to allow for the consolidation of all four properties (4570, 4572, 4574, and 4576 Claire Chennault Dr.) under the same agreement as each becomes available without further amendment or modification of the lease. The First Amendment further provides for its expiration date of June 30, 2024, at which time Jani-King and Cavanaugh agree to vacate and surrender all four properties pursuant to the terms of the agreement.

Prior to entering into the proposed First Amendment, the parties must first terminate the existing conventional hangar lease affecting 4570 Claire Chennault Dr. The proposed Conventional Hangar Lease Early Termination Agreement is included herein for the Town’s consideration and consent. Should the Town elect not to approve the proposed First Amendment, the early termination agreement would be null and void.

The city attorney has reviewed the proposed First Amendment to Conventional Hangar Lease for Commercial Aviation Use and the Conventional Hangar Lease Early Termination Agreement and finds both acceptable for the Town’s purposes. Both agreements have been executed by Jani-King as evidenced in Exhibit “A” and Exhibit “B” attached to the Resolution.

Consider Action on a Resolution Approving an Agreement with Jacobs Engineering Group, Inc. for Design Support During Construction Related to the Keller Springs Reconstruction Project and Authorizing the City Manager to Execute the Agreement in an Amount Not to Exceed $400,000.

The purpose of this item is to award a Professional Service Agreement (PSA) with Jacobs Engineering Group, Inc. (Jacobs) for design support during construction for the Keller Springs Road Reconstruction Project. 

Design Support During Construction Services are an industry standard for construction projects to ensure the construction contractor utilizes means and methods that comply with the contract requirements. Jacobs is the Engineer of Record for the Keller Springs Road Project design. Therefore, they are uniquely positioned to provide design support services because the Engineer of Record must be notified of or approve any requested interpretations and deviations by the construction contractor during construction.

The Scope of Work and a listing of fees for the anticipated services can be found in Exhibit A of the PSA. Services to be provided include meeting attendance and preparation; review of requests for information; review and acceptance of submittals; change order/field order reviews; landscape and irrigation reviews; traffic signalization reviews; other reviews and assistance; preparation of record drawings; and, additional services as requested by the Town. This scope also covers the design changes needed to optimize the project prior to rebid.  The amount of the PSA is not to exceed $400,000.

Consider Action on a Resolution Approving an Agreement Between the Town of Addison and Kleen Pipe Inc. for the Repair of the Celestial Place Stormwater Piping and Authorizing the City Manager to Execute the Agreement in an Amount Not to Exceed $57,471.25.

The purpose of this item is to approve an agreement with Kleen Pipe to repair underground stormwater pipes on Celestial Place.

These services will be purchased through BuyBoard. This state-wide collective purchasing agency bids out services and products for its members to provide the leverage needed for better pricing on products, equipment, and services.

Town staff inspected the stormwater pipe last year after noticing some pavement failures in the area. It was discovered that the stormwater line underneath the street had separation at multiple pipe joints, allowing sediment and debris to infiltrate the stormwater line. The attached price quote reflects the cost of the needed stormwater line repairs. Another contractor will repair pavement damage caused by the infiltration of the stormwater pipes, which is not included in this Kleen Pipe agreement. 

This purchase was approved as a decision package as part of the FY23 budget process and is budgeted in the FY23 Stormwater Operations and Maintenance budget.

Present, Discuss, and Consider Action on Acceptance of the Fiscal Year 2022 Annual Comprehensive Financial Report (ACFR).

The Addison Town Charter requires that staff prepare an Annual Comprehensive Financial Report (ACFR) that shows the status of the Town’s finances. The ACFR is required to be prepared in accordance with generally accepted accounting principles. The charter also requires that the Town’s financial statements be audited annually by an independent external auditing firm. The results of the independent external audit are included in the ACFR.  

The Town of Addison Finance Department has prepared the ACFR for the fiscal year ended September 30, 2022. The ACFR is a report of the Town's overall financial results. The Town's financial statements have been audited by FORVIS, LLP, an independent firm of licensed certified public accountants. The goal of the independent audit is to provide reasonable assurance that the financial statements of the Town are free of material misstatement. 

In addition to providing an overview of the Town of Addison ACFR for Fiscal Year 2022, FORVIS will present their audit report and opinion on the Town's financial statements.

FORVIS has issued an unmodified opinion, which means that financial statements are presented fairly, in all material respects, and in accordance with the applicable financial reporting framework.  Simply stated, an unmodified opinion is a clean opinion.

The Addison Planning and Zoning Commission, meeting in regular session on January 17, 2023, voted to recommend approval of an ordinance changing the zoning on property generally located at the southeast corner of Addison Road and Festival Way and the Northeast corner of Quorum Drive and Arapaho Road, which property is currently zoned Commercial-1 (C-1), Planned Development (PD), and Urban Center (UC), to a Planned Development (PD) to allow for a transit-oriented mixed use development comprised of multifamily residential, office, parking, restaurant, retail, and entertainment uses, and associated public and private open space and common areas, through the approval of a concept plan and development standards, subject to the following condition: 

• The development is executed in accordance with the attached Concept Plan, Master Streetscape Plan, and Planned Development District (PD) development standards, and the definitive agreements to be negotiated for the project.
• Lot 4X, Block A (fitness programming) will be fully entitled prior to site infrastructure construction commencement and will be completed prior to issuance of a Certificate of Occupancy for Lot 1, Block A (Stream Office).
