AGENDA CAPTION:
Consider Action on a Resolution for the Financial Plan and Rate Model for Water and Sewer Utility Rates.
BACKGROUND:
This resolution will approve a policy to adopt utility rates as set forth in the financial plan and utility rate model created by Raftelis Financial Consultants, Inc. (Raftelis) and presented at the June 14, 2022 Council meeting. The Town's current utility rate model extends through Fiscal Year 2023. The Town hired Raftelis to update and extend the rate model through Fiscal Year 2028. The rate model update was conducted according to the policy adopted by Council in 2018 to include a mix of cash and bond funded capital projects, to maintain a fund balance of at least 25%, and provide systematic rate increases. The Council gave direction at the June 14, 2022 Council meeting to continue the policy and adopt utility rates to provide a mix of cash and bond funding for capital improvement projects and maintain a minimum fund balance of 25% of operating expenses by utilizing cost of service adjustments. The new adjustments, which will take effect beginning October 1, 2023, will include the following proposed increases to water and sewer rates: Fiscal Year 2024: 5.5% Fiscal Year 2025: 5.5% Fiscal Year 2026: 5.5% Fiscal Year 2027: 4% Fiscal Year 2028: 3.5% Staff will review this utility rate model on an annual basis to ensure the rate adjustments are appropriate.
RECOMMENDATION:

Consider Action on an Ordinance Revising Sec. 78-175 'Overnight Parking of Certain Vehicles Within Residential Areas Prohibited' of the Code of Ordinances to Clarify Language for Enforcement of Commercial Vehicle Parking.
BACKGROUND:
At its June 14, 2022 Work Session, the City Council held a discussion and directed that the ordinance regarding residential commercial vehicle parking prohibitions be amended. The proposed changes are: Sec. 78-175 Overnight Parking of Certain Vehicles within Residential Areas Prohibited. Amending the truck capacity limitation, removing the 1-ton capacity, to reflect a maximum allowable dimensional limit of 25 feet in length, 10 feet in height, and 8 feet in width. Add language defining a Personal Business Vehicle. Inclusion of a Restricted Parking Map depicting the residential areas to which the residential parking restrictions will be applied. Staff will be presenting an updated ordinance that addresses these proposed changes. Pursuant to the Home Rule Charter (Section 2.12) every Ordinance imposing any penalty, fine or forfeiture for any violation of any of its provisions must have the caption published at least one time within ten (10) days after final passage thereof in the official newspaper of the Town. Such Ordinance shall take effect ten (10) days after the date of such publication.

BACKGROUND:
This item would authorize eminent domain proceedings as necessary for the acquisition of additional right-of-way needed in those cases where agreement cannot be reached on property purchases for the reconstruction projects of Keller Springs Road and Airport Parkway. On April 13, 2021, Council authorized the City Manager to sign the purchase documents for additional right-of-way and easements that will be needed for the reconstruction of Keller Springs Road and Airport Parkway. Negotiations with the sixteen affected property owners have been ongoing. Several property owners have agreed to donate, sell the right-of-way for the appraised value, or have submitted a reasonable counteroffer. Staff anticipates that some property owners will not be willing to accept the appraisal amount for the property. For the project to stay on schedule, it is necessary to obtain authorization to use eminent domain proceedings to acquire these properties. The attached resolution declares the public purpose of the reconstruction project. It authorizes the use of the eminent domain in those cases where an agreement cannot be reached with the property owner.
RECOMMENDATION:

BACKGROUND:
The Addison Planning and Zoning Commission, meeting in regular session on June 21, 2022, voted to recommend approval of an Ordinance Adopting a Development Plan for Block D of the Addison Grove Addition, including a Site Plan, Landscape Plan, Building Elevations, and Floor Plans for 54 townhome lots and one open space lot in an existing Planned Development District (PD), through Ordinance O16-003, located on approximately 2.08 acres located at the Southwest Corner of Magnolia Street and Runyon Road, approximately 400 feet south of Belt Line Road, subject to the following conditions: A replat and associated air rights easements are approved and filed prior to release of any Block D building permits in order to account for required street and alley name modifications and off-lot building aerial encroachments at alley entryways. An 8-inch waterline connection is made between existing waterlines within the Magnolia Street and Beltway Drive rights-of-way prior to release of any Block D building permits. The required public safety connection and associated bollards that are co-located at this location may be installed concurrently or at the time of construction of the closest adjacent lots. The public park situated within Block A is completed and accepted by the Town prior to the release of any Block D building permits. No portion of the existing screening wall fronting towards Beltway Drive may be removed without providing at least two weeks of prior notice to the Town.
