BACKGROUND:

Beginning in Fiscal Year 2018, the City Council's Strategic Plan included a milestone to review Town ordinances and regulations to modernize them and facilitate redevelopment. To address this strategic need, the Town engaged Clarion Associates in June 2018 to review the Town’s current development regulations and to create a new Unified Development Code (UDC) shaped by a robust public review process.

The UDC drafting and review process is comprised of four code drafting phases, a testing phase, and public review and adoption of the consolidated UDC document. The four code drafting phases are:

Zoning Districts and Uses
Development and Design Standards
Administration and Procedures
Signs and Communication Facilities

Following kickoff of the project in the summer of 2018, the project team initiated a thorough review of the Town’s existing zoning and development regulations, which ultimately culminated in the Development Regulations Assessment Report. This report was shaped by initial feedback received during the first UDC Advisory Committee meeting and through additional engagement with Town staff. The Development Regulations Assessment Report was formally presented in March 2019 at the second UDC Advisory Committee meeting, a subsequent community workshop, and a joint meeting of the City Council and Planning and Zoning Commission.

After receiving feedback on the Assessment Report, the project team began drafting the Zoning Districts and Land Use sections of the UDC. Drafts of these components were presented in September 2019 at the third UDC Advisory Committee, a subsequent community workshop, and at a November 2019 joint meeting of the City Council and Planning and Zoning Commission.

At the conclusion of the first code drafting phase, the project team began the drafting and review process for the Development and Design Standards section of the UDC. From December 2019 to September 2020, Town staff and Clarion Associates exchanged feedback on these components while public meetings associated with the UDC project were suspended due to the ongoing COVID-19 pandemic. With pandemic conditions improving and the Director of Development Services position being filled on a permanent basis, the project team is ready to restart this project.

Based on remaining project needs, staff recommends the following completion schedule for the UDC:

With this proposed project schedule, the project team recommends funding two additional consultant trips during the Development and Design Standards project phase to support the facilitation of two additional UDC Advisory Committee meetings. This would allow the committee to take an incremental approach to this very lengthy and complex section, thereby providing additional time to work through challenging regulatory issues such as landscaping, parking, building design, and residential transition standards. The anticipated financial impact of this request is $16,000, pending any elevated travel costs resulting from the COVID-19 pandemic.

Leading up to this meeting, staff has attempted to contact each committee member to confirm their continued participation in this process. Of the twelve appointed committee members, ten remain very committed to this project, one will soon be moving out of Addison, and another is nonresponsive and did not participate in previous committee events. Staff also seeks feedback regarding City Council’s desire to appoint new members to fill these positions.

RECOMMENDATION:

Staff seeks direction from Council.

Consider Action on an Ordinance Amending Appendix A (Zoning), Article XIII (Nonconforming Uses) of the Code of Ordinances of the Town of Addison, Texas to Add Section 11 – Nonconformity Due to Outside Action.
BACKGROUND:
It has been the Town’s practice to implement elements of the Master Transportation Plan when performing major reconstruction or replacement of roadways. This practice often results in the need to acquire additional rigth-of-way (ROW) to accommodate wider sidewalks, medians, and enhanced landscaping. The loss of property due to this acquisition can cause properties that were previously in conformance with the Town’s zoning ordinances to become nonconforming or push properties further into nonconformity. This item codifies the ability of the Town to allow existing buildings brought into non-conformity (insufficient setbacks, parking, landscaping, etc.) with the Code of Ordinances to lawfully exist when the cause of the nonconformity is the acquisition of ROW by the Town or other specified governmental agencies. Such allowances have typically been granted via individual agreements between property owners and the Town. This Ordinance assures property owners that a qualifying nonconformity will remain exempted for the life of the building. Any redevelopment, new construction, or expansion of existing structures on the property will be required to meet zoning and development standards in effect at that time. This is a best practice employed by municipalities to deal with corridors that are expanding and impacting existing development. Future ROW acquisition will be needed as we reinvest in our transportation corridors.

Consider Action on a Resolution Appointing a Voting Member and Alternative Representative of the Advisory Committee for the Trinity River Authority's Central Wastewater Treatment System.
BACKGROUND:
This item appoints Town representatives to an Advisory Committee for the Trinity River Authority's Central Wastewater Treatment System which provides wastewater treatment services to the Town. Section 6.10 of the contract between the Trinity River Authority and the Town of Addison states that "the City's governing body shall annually appoint one of the members of its governing body or one of its officers as a voting member of the Advisory Committee for the Authority's Central Wastewater Treatment System." The term of the voting member shall be 12 months. The Central Wastewater Treatment System Bylaws further specify that an alternate representative shall also be appointed. Currently, the Advisory Committee is primarily comprised of staff members with few cities appointing elected officials. It is recommended that Wilson Kakembo, Capital Project Manager for the Public Works and Engineering Services Department, continue his appointment as the voting member and that Shannon Hicks, Director of Public Works and Engineering Services, be appointed as the alternate representative. Each shall serve a 12-month term.
RECOMMENDATION:

Consider Action on a Resolution Denying Oncor Electric Delivery Company LLC's Application for Approval of a Distribution Cost Recovery Factor.
BACKGROUND:
The purpose of this Resolution is to deny the Distribution Cost Recovery Factor application filed by Oncor Electric Delivery Company LLC (Oncor) on April 8, 2021 which seeks to increase distribution rates by approximately $97.8 million annually. It is standard practice to pass a Resolution as the first step in a process to review Oncor's application and attempt to negotiate with Oncor regarding this proposed increase. The Council approved a similar Resolution on April 28, 2020 in response to an application for a rate increase made by Oncor. Addison is a member of the Oncor Cities Steering Committee (OCSC). The OCSC is comprised of similarly situated cities served by Oncor that have joined together to efficiently and cost effectively review and respond to electric issues affecting rates charged in Oncor's service area. The OCSC will engage with consultants and legal council on behalf of the member cities to resolve issues with Oncor's filing. The attached Resolution: Authorizes the Town to participate with the OCSC; Authorizes the hiring of Lloyd Gosselink and consultants to review the filing, negotiate with Oncor, make recommendations to the Town regarding reasonable rates, and to direct any necessary administrative proceedings or court litigation associated with an appeal of Oncor's DCRF application; States the rates proposed by Oncor are found to be unreasonable and should be denied; States that Oncor should continue to charge its existing rates to customers within the Town; States that Oncor shall reimburse the City for its reasonable rate case expenses; States that the Resolution was passed at a meeting that was open to the public and that the consideration of the Resolution was properly noted; and, States to whom a copy of the approved and signed Resolution will be sent.
RECOMMENDATION:
Adminsitration recommends approval.

Consider Action on a Resolution Authorizing the City Manager to Execute the Assignment and Assumption of the Economic Development Incentive Agreement for Village on the Parkway from 5100 Belt Line Road Investors LLC to VOP Partners, LLC.
BACKGROUND:
This Resolution provides for the Economic Development Incentive Agreement (EDIA) in place for Village on the Parkway to be transferred to the new owners upon closure of the sale of the property. Per the existing EDIA between the Town of Addison and 5100 Belt Line Road Investors, LLC, the existing owner of Village on the Parkway is allowed to transfer the incentive agreement to new owners upon approval and acknowledgement by the Town of Addison. This would be the second transfer of the EDIA to new owners following the original execution of the EDIA on August 22, 2014. UBS Investment Bank, through 5100 Belt Line Road Investors, LLC took ownership of Village on the Parkway on May 12, 2015, and the Town of Addison authorized the transfer of the existing incentive agreement then. UBS Investment Bank, the current owners of 5100 Belt Line Road Investors, LLC, has informed the Town of Addison that they are under contract to sell Village on the Parkway Retail Shopping Center to VOP Partners LLC, a Texas limited liability company. The new buyers are currently performing their due diligence which is scheduled to expire April 29, 2021, and closing is anticipated June 2, 2021. VOP Partners, LLC, is a well-funded partnership comprised of five local, high net worth individuals including Bo Avery, Jessie Mann and Rohit Mehrotra. The partners have been actively involved in commercial real estate since 1990 and have cumulatively acquired over 2 million square feet of retail shopping centers in Texas alone. The partnership has sufficient equity capital to close on the acquisition using partnership funds and is also strategically working with Wells Fargo to secure debt financing. Tri Marsh Retail, LLC, an entity owned and controlled by Bo Avery, will oversee the daily management of the property. The assignment of the incentive agreement does not alter the performance based incentive agreement. The new owners will assume performance of all the obligations, covenants, duties and liabilities of the existing incentive agreement upon full execution of the attached Assignment and Assumption of Economic Development Incentive Agreement.

BACKGROUND:

In May of 2012, Addison voters approved $2,000,000 in General Obligation bonds for the design and installation of a secure city-wide wireless network infrastructure to provide video, data, and voice applications for First Responders and the protection of certain infrastructure areas.

On October 23, 2018, Council approved a phased implementation strategy for a License Plate Recognition (LPR) and Optical Camera Pilot Project in an amount not to exceed $600,000 to install:

Twenty (20) LPR cameras at eight (8) intersections and neighborhood entrances at the following locations:

Oaks North Drive and Belt Line Road
Belt Line Road and Winnwood Road
Celestial Road and Montfort Drive
Proton Drive and Midway Road
Beltway Drive and Marsh Lane
Surveyor Boulevard and Belt Line Road
Beltway Drive and Midway Road
Palladium Drive and Montfort Drive

Seven (7) Optical Cameras at the following locations:

White Rock Creek – 2 cameras – One at each entrance
Easement Park – 5 cameras – Fire Station 2, Dog park, Bush Elementary School, and 2 cameras at Marsh Lane entrance

On August 25, 2020, Chief Paul Spencer provided Council with an update on the Pilot Program including lessons learned and the successes achieved. Consequently, Council directed staff to expand the Pilot Project.

On October 16, 2020, the Town advertised a Request for Proposals for the implementation of an advanced optical camera system that will allow the Town's staff to view, record, and archive video feeds from any location and any device with an Internet access. Seven (7) sealed proposals were received. The proposals were evaluated on five (5) year cost of ownership, qualifications, and project design and methodology. The evaluation results are shown in the table below:

The highest-ranked proposal was submitted by STS360. They will install a total of two hundred and eighty one (281) cameras. One hundred and eleven (111) cameras will be at the new locations listed below for the expansion of the Optical Cameras. One hundred and seventy (170) optical cameras will replace the existing camera systems at Town’s facilities. The existing camera systems were installed almost eight (8) years ago and they are budgeted to be replaced in the Fiscal Year 2021 Information Technology Replacement Fund.

The following locations were selected by staff based on the Phased Implementation Strategy that was presented to the Council on July 10, 2018 to install Optical Cameras in the Town parks, trails, and facilities. These recommended locations will complement the existing Optical Camera network, and it aligns with and supports the crime mitigation strategy to support and enhance the public safety efforts protecting the Town’s residents and businesses.

The total cost of the system implementation including, hardware, software, licenses, 5 years comprehensive onsite support and maintenance, seven (7) year hardware warranty for the outdoor cameras, ten (10) year hardware warranty for the indoor cameras, and electrical and installation services, is $1,102,648.54. The source of funding for this project are:

$400,000 contribution from the Fiscal Year 2021 Information Technology Replacement Fund for replacement of the existing camera systems.
$200,000 contribution from the Fiscal Year 2021 Airport Fund.
$502,648.54 contribution from the 2012 Bond Fund balance.

This project is anticipated to take 6 months to complete.

Since the LPR technology is in its infancy and there are only a handful of vendors offering LPR system nation-wide, staff decided not to release a Request for Proposal. Instead, staff contacted two leading LPR vendors to evaluate their technologies for 3 months. At the end of the trial period staff decided to continue using Vigilant technology for the expansion of the LPR system. Staff’s decision was based on their findings comparing these systems, the effectiveness of Vigilant technology and a commercial database search feature that is offered only by Vigilant system. The following are twenty-three (23) locations recommended by Chief Spencer for the expansion of the License Plate Recognition network city-wide. Vigilant will install a total of Sixty (60) LPR cameras at these locations. The recommended locations were selected based on the data collected during the Pilot Project. These recommended locations will complement the existing LPR network, and it aligns with and supports the crime mitigation strategy to support and enhance the public safety efforts protecting the Town’s residents and businesses. Present, Discuss, and Consider Action on an Ordinance to Amend the Town’s Annual Budget for the Fiscal Year Ending September 30, 2021 to Provide Funding for Conducting and Implementing a Compensation Market Study, Self-Contained Breathing Apparatus, Holiday in the Park, Signal Pole Replacements, Cardiac Monitors, Midway Road Reconstruction, and Prior Year Encumbrances.

BACKGROUND:

The Fiscal Year (FY) 2021 budget was adopted by Council on September 8, 2020. This is the first amendment for the FY2021 Town of Addison annual budget.

Each year, Finance staff reviews the budget to determine which items should be recognized with formal budget amendments. When budget variances occur that are outside of the authority of the City Manager these adjustments are presented to the Council in the form of a budget amendment.

During the FY 2021 budget process, Council gave direction to conduct market study, which was budgeted in FY 2020, but not conducted due to the pandemic. An amendment is needed for cost of conducting the study in the amount of $25,000 to the Self-Funded Projects Fund. On February 9, 2021 Council approved the results of that market study which includes increased appropriation in the General Fund in the amount of $545,000 for the remainder of FY 2021. Additionally, Council gave direction on October 27, 2020 to conduct a holiday event that was not budgeted due to the pandemic and closure of the Conference Centre. The appropriation requested for this event is $50,000. Council accepted the Assistance to Firefighters Grant for FY 2019 on August 25, 2020 and approved a resolution to purchase Self-Contained Breathing Apparatus’ on September 22, 2020. The expenditures were not part of the FY 2021 original budget, therefore, amendments of $3,766 and $86,668 are needed from the General Fund and Capital Equipment Replacement Fund, respectively. In the General Fund additional Sales Tax of $598,766 offsets the increased appropriations.

Residual bonds funds in the 2013 General Obligation Bond Fund are requested to be utilized for traffic signal pole replacements in the amount of $61,000 and to fund a portion of the Midway Road Reconstruction project in the amount of $147,000.

An amendment is needed in the 2014 General Obligation Bond Fund for a prior year encumbrance for the Belt Line 1.5 project in the amount of $170,000.

An amendment is needed in the 2018 Certificates of Obligation Bond Fund for a prior year encumbrance for the Customs Facility project in the amount of $1,350,000.

An amendment is needed in the Self-Funded Projects Fund for prior year encumbrances for Trails Master Plan ($66,242), Addison Athletic Club Design ($33,750), Cityworks software implementation ($25,306), and Sojourn Drive Design ($7,500). Additionally, an amendment is needed for the purchase of two Lifepak 15 Cardiac Monitors, approved by Council on December 8, 2020, in the amount of $98,400 utilizing Texas Ambulance Services Supplemental Payment Program funds that were received in October 2020.

An amendment is needed in the Capital Equipment Replacement Fund for prior year encumbrances related to one police vehicle that was not delivered prior to October 1, 2020 and the outfitting of police vehicles that did not occur until after October 1, 2020 in the total amount of $135,000.

BACKGROUND:
At the March 23, 2021 City Council meeting, staff conducted a work session with Council to receive direction on the status and proposed completion options for the Sam’s Club Special Area Study. That dialogue concluded with Council directing staff to engage consulting services and to issue a call for volunteers to serve on a project advisory committee, tasked with completing the study. In accordance with the proposed scope of services prepared by the Town’s planning consultant, Strategic Community Solutions, the project advisory committee will meet three times over the course of the six-month project schedule, and will also participate in the two community input meetings that are programmed for the project. The role of the project advisory committee will be to inform and advise the planning process and to support outreach efforts to Addison residents, the business community, and other key stakeholder groups. On April 2, 2021, the Town issued a call for advisory committee volunteers in the Town Newsletter and through the Town’s social media channels. The deadline to apply to serve on the project advisory committee is Friday, April 23^rd. Strategic Community Solutions advised that an ideal advisory committee should include representatives from the surrounding neighborhoods as well as property and business owners within and adjacent to the project study area. The applications that were received have been made available to Council for consideration. Additionally, staff has provided a roster of study area property owners in the event that more targeted recruitment is needed for that advisory committee to ensure sufficient participation in the process. Should the Council desire to take action, the attached resolution allows for Council to appoint members to the project advisory committee for the applications that have been received. For resident applicants, staff recommends that each council member appoints two applicants to the committee. For business property owners, staff requests direction from Council regarding the number of committee appointments and any consensus preferences for specific business property owner participants.

BACKGROUND:
At the March 23, 2021 City Council meeting, staff conducted a work session with the Council to receive direction on the status and proposed completion options for the Sam’s Club Special Area Study. That dialogue concluded with Council directing staff to engage consulting services and to issue a call for volunteers to serve on a project advisory committee, tasked with completing the study. To best compliment the staff recommendation of evaluation and refinement of the existing study, staff recommended to Council that the Town engage available consultant team members from the 2015 Sam’s Club Special Area Study planning effort. Reflecting this direction, staff requests Council action on a Professional Services Agreement between the Town and Strategic Community Solution LLC, a Dallas-based urban planning and facilitation firm led by its managing principal, Karen Walz, who served as the project manager for the initial planning process. With this proposed agreement, Strategic Community Solutions has worked with staff to develop a scope of services and project schedule that reflects current needs for the study area and a robust public engagement process that will be further supplemented by targeted engagement efforts by Town staff. The proposed scope of services includes the following tasks: Stakeholder and Public Engagement. Strategic Assessment, Site, and Market Analysis Update. Development Concept Refinement and Public Review Process. Final Plan Development and Public Review Process. To support this project, Strategic Community Solutions has engaged Kimley-Horn and Associates, Inc., a full-service engineering and urban design firm, as a sub-consultant. Mark Bowers will serve as the Assistant Project Manager and will lead the development of the study area development concept. Mr. Bowers is also based in Dallas and has collaborated with Strategic Community Solutions on many similar projects over the last several decades. These shared experiences include the initial Sam’s Club Special Area Study, as well as the Addison Circle Special Area Study. Mr. Bowers’ team also completed the Town’s Master Transportation Plan. Collectively, Ms. Walz and Mr. Bowers bring over 70 years of urban planning and project facilitation experience to this project. The project is anticipated to take six months to complete and has been scoped to remain within budgeted amounts. The agreement with Strategic Community Solutions is a lump sum contract not to exceed $132,891.
