AGENDA CAPTION:

Discuss And Consider Action Needed For Reimbursement Of Legal Expenses For The Mayor's Defense Of Complaints Filed With The Texas Ethics Commission That The Mayor's Newsletter Is "Political Advertising."

BACKGROUND:

On March 24, 2016, Mayor Todd Meier received a Notice of Complaint filed by James Duffy from the Texas Ethics Commission. On April 8, 2016, Mayor Meier received a second Notice of Complaint filed by John Oliver. Within their sworn complaints, Complainant Duffy and Complainant Oliver allege that Mayor Meier used public funds for political advertising, in violation of the Texas Election Code, Section 255.003.

The complaints and the Mayor's response are attached to this agenda item. This item is to allow the Council to discuss and consider reimbursement of legal expenses.

RECOMMENDATION:

Staff seeks direction from Council.
