Consider Approval Of Change Order 6 To John Burns Construction, Inc. For The Belt Line Road Underground Utilities Project In An Amount Not To Exceed $129,950.
BACKGROUND:
Change order 6 proposes a shift of work from Oncor to John Burns Construction for the installation of concrete pads. This change order will not increase the overall project cost or add additional time, but will increase the payment to John Burns Construction.

Construction on the Belt Line Road Utility Relocation from Marsh Lane to Midway Road began in late 2014.  The project includes removing the overhead power and telecommunication lines and placing them in underground concrete duct structures.  There are also a number traffic signal, sidewalk, ramp, and Americans with Disabilities (ADA) improvements in the project as well.

Council has previously approved 4 change orders for this project:

Change Order #1 approved the addition of 180 days (6 months) of construction time and a $27,972 cost increase for concrete due to the delay from the time of bid award to the placement of the concrete order.  This was due to the decision to delay the award of the bid and hold public meetings concerning the overall project budget.

Change Order #2 was never finalized and therefore was voided.

Change Order #3 upgraded the pedestrian crossings along Belt Line Road to incorporate new ADA regulations.  The new pedestrian buttons will include audible notifications.  The increase contract amount for Change Order #3 was $31,990 and added no additional time.

Change Order #4 was for the cost to remove contaminated soils encountered during excavation operations on the west side of the intersection of Belt Line Road and Marsh Lane.  The increased contract amount for Change Order #4 was $11,172 and added 10 days to the contract time.

Change Order #5 included several items:  additional duct bank conduit to aid in tying the north and south sections of telecommunication duct banks together, additional tree removal and replacement to remove the double row of trees located in several medians with a single row of high-rise live oaks, installation of updated traffic detection equipment at the Business Drive and Marsh Lane intersections, and the shifting of the AT&T cable installation (pulling) effort from AT&T to John Burns Construction.

Change Order #6 proposes to shift some of the installation work from Oncor Electric to John Burns Construction (JBC).  During the initial bid for the project, the installation of the concrete pads on which the electrical transformers and switch gears will sit was to be the responsibility of the successful bidder.  The bid amount to perform this work was $139,260.  Since only one bid was received in the first bid posting, the project was re-bid.  In the second bid posting the installation of these concrete pads was shifted to Oncor to perform as part of the agreement with them.   We do not have bid prices from Oncor, but they concurred that the bid amount was in line with their costs.  Due to recent workload demands, Oncor has now indicated that their construction crews are behind schedule on other projects and they are not available to do the Belt Line work in the timeframe that we need.  The installation of the concrete pads is critical to being able to move forward on the rest of the construction activities.  Therefore, we proposed to Oncor that John Burns Construction do this work instead as was originally intended.  Oncor has agreed to this change.   This change will allow us to maintain the current schedule for completion of the civil construction as December 2016.  John Burns has also agreed to perform this work at cost, with no markup.  The original bid amount for this work was anticipated to be $139,260.  John Burns will now do the work for $129,950, a savings of $9,310 from the original bid price. The change also has no impact on the schedule for completion of the project.

The attached change order has been reviewed by Town staff and the project manager and it has been found to be fair and reasonable.  Completion of the John Burns Construction related work is currently set for December 2016.  Once JBC's construction contract work has been completed, Oncor and the telecom companies will remove their wires from the overhead poles.  Oncor will then remove the poles after all of the lines have been taken down.

The overlay of Belt Line will be bid upon the completion of the JBC construction contract work and is estimated to take 8-10 months for full construction after bids are received.
RECOMMENDATION:
Administration recommends approval.
