AGENDA CAPTION:
Consider Action to Approve an Ordinance Amending Chapter 62 Signs to Provide a Definition for Flags and to Allow Display of Flags During Certain Periods Proximate to Federal Holidays.
BACKGROUND:
Currently, the Sign Code limits properties to displaying a maximum of three flags. These flags can either be the United States, Texas, or Addison flag. Additionally, the Code limits such flags to no more than 40 square feet and requires that they be on a flag pole of no more than 30 feet. All other types of flags are considered signs and are not allowed. Additionally, no other types of patriotic displays are currently allowed by the Code as they are considered to be either portable, moving, banner, or flag signs, which are all prohibited.

Some individuals in the community have expressed a concern that this is an overly restrictive requirement, particularly during time periods associated with patriotic holidays such as Memorial Day and Independence Day. Staff intends to discuss this issue with the community further during the development code review and revision process which will be starting in August 2018. This, however, will be a two-year process. As a temporary alternative, staff is proposing to amend the Sign Code to remove limitations on the number of flags that may be displayed on any property for the time period ranging from the five days prior to any national holiday through three days after the holiday.

Additionally, staff is proposing to define a flag as any fabric or bunting containing distinctive colors, patterns, symbols or graphic depictions, but not including text.
RECOMMENDATION:
Administration recommends approval.
