AGENDA CAPTION:

Consider Action to Approve a Resolution for an Easement and Right Of Way Agreement Between the Town of Addison and Oncor Electric Delivery Company, LLC, to Obtain a Drainage Easement on Oncor Property Associated with the Sherlock Drainage Improvements and Authorizing the City Manager to Execute the Agreement.

BACKGROUND:

In order to construct a storm drain system improvement in the vicinity of Winter Park Lane and Sherlock Drive, a new easement is needed with Oncor Electric Delivery Company, LLC, for the use of their property to extend the storm drain system approximately 1,350 feet from the vicinity of 3907 Winter Park Lane to Belt Line Road. The easement will house a 54-inch concrete storm drain pipe and associated appurtenances that will carry the storm water from the Winter Park Lane and Sherlock Drive area to the storm drain system on Belt Line Road, thereby alleviating flooding in that area.

Oncor has approved the easement language and survey and the easement will be executed upon approval by the City Council. Once the Town approves and signs the easement, Oncor will execute the documents and send a final copy to the Town. The easement will be granted for and in consideration of the payment of Ten Dollars ($10.00).

The Town currently has a utility easement at 3907 Winter Park Lane that will need to be expanded to accommodate the larger diameter storm drain pipe. This easement is being brought foward for approval by Council in a separate agenda item.

RECOMMENDATION:

Administration recommends approval.
