AGENDA CAPTION:

Consider Action to Approve a Resolution Authorizing the Use of Eminent Domain to Reroute the Town of Addison's Sanitary Sewer Flow, Along Beltway Drive and to Midway Road, into Addison's Sanitary Sewer System, Through the Acquisition of Permanent Utility Easements and Temporary Construction Easements.

BACKGROUND:

On April 24, 2018 Council authorized the rerouting of a portion of Addison’s sanitary sewer flow through easements along Beltway Drive to Midway Road into Addison’s sanitary sewer system. This reroute will cease the current sewer flow in to the Farmers Branch sanitary sewer system. The design for the rerouting of the line is 100% complete. It is necessary to obtain easements and other real property interests to complete the project.

It may be necessary to use eminent domain to obtain the easements and real property interests needed to complete the reroute project. Therefore, this item asks for the authorization to use eminent domain, if needed.

RECOMMENDATION:

Administration recommends approval.
