AGENDA CAPTION:

Administer the Oath of Office to three (3) Council Members following the originally scheduled May 4, 2024 election date in accordance with State law and Ordinance No. O24-05 which declared the Council Members unopposed and therefore elected.

BACKGROUND:

In March 2024, Interim City Secretary Valencia Garcia submitted to the City Council a Certification of Unopposed Candidates certifying that no person had made a declaration of write-in candidacy for the May 4, 2024 General Election and that Chris DeFrancisco, Howard Freed, and Darren Gardner were unopposed. At the March 5, 2024 Council Meeting, the City Council adopted Ordinance No. O24-05 which officially declared the unopposed candidates elected to office. Candidates elected through cancelation must also qualify for office and take the oaths of office, the same as candidates elected in an election.

The Texas Constitution prescribes a written statement that all elected city officers must sign and an oath that all elected city officers must take before they enter upon the duties of their offices. These actions are to occur after the election is canvassed. Although the May General Election was canceled, the procedures for candidates elected through the cancelation procedure remain the same except that no canvass is conducted. The written "Statement of Elected Officer" has been completed prior to this meeting. This agenda item will fulfill the oath requirement.
