AGENDA CAPTION:
Consider action on a Resolution for an Interlocal Cooperative Agreement Between The North Central Texas Council of Governments and the Town of Addison Concerning Cotton Belt Regional Trail Local Contributions and authorize the City Manager to execute the agreement.
BACKGROUND:
The Addison portion of The Cotton Belt Trail is a part of the Cotton Belt Trail Corridor that will ultimately provide an active transportation connection between Plano and Fort Worth. Since 2018, Dallas Area Rapid Transit (DART) has been working cooperatively with the North Central Texas Council of Governments (NCTCOG) and respective cities along the Silver Line Corridor on a regional partnership to design and construct the Cotton Belt / Silver Line Rail Trail within the DART owned right-of-way. DART is coordinating engineering design, funding applications and construction of the trail through the Federal Transit Administration (FTA).  In May 2023, the Regional Transportation Council (RTC) programmed $87,034,305 for the construction of the Cotton Belt Regional Trail in portions of Tarrant County and in Dallas County. The currently approved trail phase of construction (Phase 2) in Addison will be from Surveyor Blvd. eastward to the Midway Bridge (Phase 2 bridge section) and then eastward to the Dallas North Tollway. The program funds awarded for the Addison Phase 2 portion of the trail require a local match, and the Town of Addison will be contributing $307,469 of local match funds previously committed with funding awards by the NCTCOG Regional Transportation Council. This funding has been set aside by Addison Finance for our local match.

On March 21, 2023, the DART Board of Directors approved a Resolution authorizing execution of an Interlocal Agreement (ILA) between DART, NCTCOG, and the RTC concerning the Cotton Belt Regional Trail to set forth responsibilities with respect to the construction and funding of the trail. On April 27, 2023, the NCTCOG Executive Board approved an Interlocal Agreement between NCTCOG, RTC and DART concerning the Cotton Belt Regional Trail and to set forth responsibilities with respect to the construction and funding of the Trail. The mutually agreed upon ILA was executed between the three parties on May 23, 2023. Therefore, on July 27, 2023, the NCTCOG Executive Board authorized this agreement (Cotton Belt Regional Trail Local Contribution ILA) to collect matching funds and any additional local contributions for the Cotton Belt Regional Trail to be transferred to DART.

This Interlocal Agreement defines that the Town of Addison will transfer the local match of $307,469 to the NCTCOG. After the NCTCOG collects the local match provided for construction of The Cotton Belt Trail, they will transfer the funding to DART in preparation for the construction process to move forward. 
RECOMMENDATION:
Staff recommends approval.
