AGENDA CAPTION:

Consider Action on a Resolution Authorizing the Use of Eminent Domain for the Acquisition of Permanent Right-of-Way, Utility Easements, and Temporary Construction Easements for the Reconstruction of Keller Springs Road and Airport Parkway from Dallas North Tollway to Addison Road, and Authorizing the City Manager to Execute all Documents.

BACKGROUND:

This item would authorize eminent domain proceedings as necessary for the acquisition of additional right-of-way needed in those cases where agreement cannot be reached on property purchases for the reconstruction projects of Keller Springs Road and Airport Parkway.

On April 13, 2021, Council authorized the City Manager to sign the purchase documents for additional right-of-way and easements that will be needed for the reconstruction of Keller Springs Road and Airport Parkway.

Negotiations with the sixteen affected property owners have been ongoing. Several property owners have agreed to donate, sell the right-of-way for the appraised value, or have submitted a reasonable counteroffer. Staff anticipates that some property owners will not be willing to accept the appraisal amount for the property. For the project to stay on schedule, it is necessary to obtain authorization to use eminent domain proceedings to acquire these properties.

The attached resolution declares the public purpose of the reconstruction project. It authorizes the use of the eminent domain in those cases where an agreement cannot be reached with the property owner.

RECOMMENDATION:

Administration recommends approval.
