AGENDA CAPTION:

Consider Action on an Ordinance Revising Sec. 78-175 'Overnight Parking of Certain Vehicles Within Residential Areas Prohibited' of the Code of Ordinances to Clarify Language for Enforcement of Commercial Vehicle Parking.

BACKGROUND:

At its June 14, 2022 Work Session, the City Council held a discussion and directed that the ordinance regarding residential commercial vehicle parking prohibitions be amended. The proposed changes are:

Sec. 78-175 Overnight Parking of Certain Vehicles within Residential Areas Prohibited.

Amending the truck capacity limitation, removing the 1-ton capacity, to reflect a maximum allowable dimensional limit of 25 feet in length, 10 feet in height, and 8 feet in width.
Add language defining a Personal Business Vehicle.
Inclusion of a Restricted Parking Map depicting the residential areas to which the residential parking restrictions will be applied.

Staff will be presenting an updated ordinance that addresses these proposed changes.

Pursuant to the Home Rule Charter (Section 2.12) every Ordinance imposing any penalty, fine or forfeiture for any violation of any of its provisions must have the caption published at least one time within ten (10) days after final passage thereof in the official newspaper of the Town. Such Ordinance shall take effect ten (10) days after the date of such publication.

RECOMMENDATION:

Administration recommends approval.
