Consider Action on an Ordinance Approving the Abandonment of a Drainage Easement within the Vitruvian West Development.

BACKGROUND:

With the completion of Vitruvian West Phase II and the ongoing construction of Vitruvian West Phase III, the Vitruvian Park development team is working with Town staff to complete remaining development entitlement and construction tasks. As part of this process, a plat application has been prepared for Town consideration that would replat the Vitruvian West block in order to establish individual lots for Phase II and III of this project. Concurrent to this platting consideration, the Vitruvian Park development team and Town staff have identified the need to abandon an existing drainage easement that was established in 1979, prior to this site redeveloping. With the Vitruvian West development, drainage infrastructure at this site has changed, eliminating the need for this easement.

Due to this easement being established by separate instrument and not by plat, the process of abandoning it requires City Council consideration and action on an easement abandonment ordinance.

RECOMMENDATION:

Administration recommends approval.
