AGENDA CAPTION:

Present, Discuss, and Consider Action on an Ordinance Declaring Unopposed the Mayoral Candidate in the May 1, 2021 Mayoral General Election, Elected to Office; Canceling the Election for the Office of Mayor; and Providing an Effective Date.

BACKGROUND:

On March 4, 2021 the City Secretary submitted to the City Council a Certification of Unopposed Mayoral Candidate certifying that no person has made a declaration of write-in candidacy for the May 1, 2021 General Municipal Election, and that the following candidate is unopposed:

Upon receiving the certification, the City Council may declare the unopposed candidate elected to office. A copy of this ordinance and certification must be sent to Dallas County Elections Department for posting at each polling place used during this election. The ballots used in this election, must include: the name of the candidate that has been declared elected under the heading "Unopposed Candidate Declared Elected" and listed in a way that prevents voters from casting votes in connection with the Mayoral Election.

The statute provides that a certificate of election is issued to each candidate who is declared elected, in the same manner and at the same time as provided for a candidate elected at the election. Candidates elected through cancellation must also qualify for office and take the oaths of office, the same as candidates elected at an election.

RECOMMENDATION:

Administration recommends approval.
